Opening a gîte or bed & breakfast in French Guiana: legal status and procedures

Every year, French Guiana draws travellers who come to watch an Ariane 6 launch from the Guiana Space Centre, paddle up the Maroni River by pirogue or watch the leatherback turtles of Awala-Yalimapo. And yet, characterful accommodation remains scarce. Opening a gîte or a bed & breakfast in this French overseas department and region (DROM) is a genuine opportunity, provided you master a specific administrative path. Here, step by step, is how to go from an idea to your first welcomed guest.

Before you start any procedure, you need to choose between two formats that French law distinguishes clearly.

The furnished tourist rental (gîte)

A gîte is legally a furnished tourist rental (meublé de tourisme): a self-contained dwelling rented to passing guests who do not take up residence there, for a maximum of 90 days per guest. The traveller has the entire dwelling (kitchen, bathroom, bedrooms) without the host present. It is the ideal format for a renovated Creole house in Roura, a fitted-out carbet near Cacao or a studio in Rémire-Montjoly.

The bed & breakfast

A bed & breakfast involves hosting in the owner’s home, with breakfast included and the owner present on site. The law limits the activity to a maximum of 5 rooms and 15 people. Beyond that, you fall under the hotel regime, which is far more demanding. This format works particularly well in Cayenne, Kourou or Saint-Laurent-du-Maroni, where the personal touch and a local host’s tips add real value.

In French Guiana, as in mainland France, tourist accommodation is a commercial activity that requires a legal status.

  • Micro-entreprise (sole trader / auto-entrepreneur): the simplest way to start. Turnover ceiling of €188,700 for rated furnished rentals, €77,700 for unrated ones. Social contributions calculated on the turnover received.
  • Sole proprietorship on actual-profit basis (au réel): relevant as soon as your expenses (renovation, loan, energy) are high, because you deduct your actual costs.
  • Company (SARL, SAS): useful for a project with several partners or assets to structure, but with heavier accounting.

Registration is free on the INPI single window (formalites.entreprises.gouv.fr), which assigns you a SIRET number. Allow 1 to 3 weeks of processing. In French Guiana, the CCI de Guyane in Cayenne and the chamber of trades support project leaders.

The mandatory town-hall declaration

This is the step many people forget, and yet it is mandatory for every furnished tourist rental as well as for every bed & breakfast.

  • Furnished tourist rental: declaration via the Cerfa form no. 14004 filed at the town hall of the municipality (Cayenne, Matoury, Macouria, Kourou, etc.). Some municipalities additionally require a registration with a 13-digit number to be displayed on your listings.
  • Bed & breakfast: declaration via the Cerfa form no. 13566.

Also look into the tourist tax (taxe de séjour), voted by each municipality or by the urban-area authority. You collect it from the traveller and pass it on to the local authority. If you live in a co-owned building, check that the rules do not prohibit furnished tourist letting.

The Atout France rating: the gateway for tourist gîtes

The star rating (from 1 to 5) is awarded at national level by Atout France, the State’s tourism development agency. It is not mandatory, but strongly recommended: it is the differentiating argument in French Guiana, where few properties are rated.

  • Major tax advantage: a micro-BIC deduction of 50% for a rated furnished rental, versus 30% for an unrated one. On the ground, that changes profitability.

How to obtain it, step by step

  1. You request a visit from an accredited inspection body (Cofrac). Few are based locally: you will often have to factor in a trip from mainland France in your budget.
  2. The inspector assesses the dwelling against a grid of 112 criteria (equipment, comfort, services, accessibility, sustainability).
  3. The report is sent to Atout France, which awards the rating.
  4. The rating is valid for 5 years, then must be renewed.

Budget €180 to €350 for the rating visit of a furnished rental. Since the grid is demanding on connectivity and air conditioning — essential under French Guiana’s equatorial climate — anticipate this equipment from the renovation stage.

Safety, insurance and health obligations

Welcoming the public engages your responsibility. The essential points:

  • Insurance: take out professional liability cover and a non-occupying owner’s insurance covering seasonal letting.
  • Smoke detectors (DAAF) mandatory in every dwelling.
  • Electrical and gas safety: installations up to standard, especially in the older houses of central Cayenne or Saint-Laurent.
  • Yellow fever vaccination: it is mandatory to enter French Guiana. State it clearly in your communications to avoid any unpleasant surprise for your travellers.
